CAL-ERT 05/17/02 8:45 A. M.
^^^^^^^^^^^^^^^^^^^^^^^^^
IMPORTANT LEGISLATIVE ACTIVITY

On Tuesday, the Assembly Judiciary Committee voted out SB682 and the Senate Judiciary Committee voted out AB496. The bills will now move to the Assembly and Senate Floors.

These bills seek to repeal part of the Civil Code 1714 that deals with product liability. These bills were redrafted and gutted/amended from bills that were initially introduced to do other things. These bills were changed after the anti-gun advocates lost their "101 California Street lawsuit" against the firearms industry in the California State Supreme Court.

The repeal of current law would only open the door of litigation to the manufacturers of lawful and legal consumer products. Manufacturers of lawful products should not be held responsible for the actions of criminals or any person who uses the product in a negligent manner.

It is important that everyone call the legislature ASAP.. These bills could be voted on as early as Monday in the Assembly (SB682) and in the Senate (AB496).

SB682 will be voted on in the Assembly.
